Searches on my Conveyancing Quote

What is included in a local authority search covering Attleborough? There are two parts to a local authority search – LLC1 and CON29. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is public or private, proposals for new road schemes, rail schemes or planning decisions relating to the house. The results can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

When we ask for a Environmental search on the property mentioned on the conveyancing quote for the property in Attleborough what will it reveal? The search provides results of present and past pollution risks together with a report from an environmental expert confirming whether or not the land parcel is likely to be classified contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flood plain area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon zone.

Apart from showing that the house in Attleborough is connected to the mains water supply and mains drainage what other results does a water authority search show? A a CON29DW shows to a potential buyer that the site they are purchasing does not need a “build over consent” because the previous owner has constructed an extension over a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

There is always likely to be mortgage finance to obtain and it should be noted that a lawyer cannot rely on a quick email by mortgage broker or anyone else. We must have sight of your official written offer of mortgage in order that he may (i) verify that you are getting the loan you need and be sure that you can comply with any special conditions imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a quote what disbursements apply to your matter and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their fees disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all outlays necessary to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Attleborough some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is situated and possibly also building insurance.

FAQs in Attleborough

Are you on the panel of Godiva Mortgages Ltd? Yes we act for all major lenders and many smaller lenders.

We are aware that you do not have an office in Attleborough? Is this a problem? No because like all modern firms of lawyers we depend on technology to assist us in our firm to ensure that matters are dealt with rapidly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Attleborough).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the the Stamp Office is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a maisonette what additional fees can we anticipate? We cannot give you all the costs up front in our estimate. The costs charged by landlords and managing agents will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from company to company often it is approximately £2500 but is can be higher in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two flats.
