Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not reveal land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your council covering Auckley. Usually, you can search most planning applications planning pages by postcode or by map search).

I am told that the official local Enquiries in Auckley will show if the land is contaminated. Is that right? That is not right. Whilst it is correct that councils are now in the process of locating polluted property and recording these land parcels on registers – this is a process which will take a decades to deliver upon. Needless to say any ground named within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Search are likely to be incomplete.

Why is a a CON29 DW search salient if you want to extent or alter the site in Auckley? One of the most useful details shows a map of any public sewer within the house you are acquiring. This is important because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the build more costly.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading buying down and have a lot of items to get rid of. You can accelerate the process if it is your first buy. You may be able to exchange and complete simultaneously. However your option depend on what  others in the chain will comply with.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest law firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays necessary to upkeep the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Auckley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Auckley

Are you able to manage a mortgage with M&S Bank in Auckley? Yes we are on the mortgage Panel for this lender.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Auckley.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no SDLT. If you are paying between £300k and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional fees can we anticipate? We cannot give you all the disbursements up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £2500 but is can be higher in extreme cases. Second, the lease may contains a agreement for the outgoing to pay a fee to the management company based on a percentage of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.
