Searches on my Conveyancing Quote

How long do local search LLC1 searches take? The timescale for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Enquiries of the local authority search through an electronic search provider some searches are still processed handled manually by the local council. Also the search wait time can be affected by seasonal demand levels and Local Authority staffing levels.

I believe that the local authority Searches in Audlem will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that Local Authorities are now in the process of locating contaminated land and recording these sites on registers – this is a process which will take a unknown period of time to accomplish. Needless to say any sites listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Enquiries are likely to be incomplete.

Why is a a CON29 DW search essential if you want to extent or alter the property in Audlem? One of the critical results shows a plan of of any public sewer adjacent the property you are purchasing. This is important because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the footings cost more.

General Conveyancing Tips

There is more often than not a mortgage loan to apply for and it should be noted that a solicitor cannot rely on a informal confirmation by mortgage broker or anyone else. The lawyer should have sight of your final written mortgage offer in order that they may (i) be able to check that you are getting the advance you need and be able to check that you can comply with any offer conditions imposed in the mortgage loan.

Always check what you are acquiring? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a customer makes is not checking the plan properly. It is a best to go to the home to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often consumers mistakenly think that a piece of land at the side or rear of the home is theirs, only to discover that the legal title to the property doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all costs incurred to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Audlem some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Audlem

Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Audlem).

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Revenue is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40k. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette what additional costs can we anticipate? We cannot give you all the costs up front in our estimate. The costs charged by landlords and managing agents will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from organisation to organisation on average it is approximately £200-300 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into 2 flats.
