Searches on my Conveyancing Quote

Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a house and do not necessarily have to conduct a search. Many such consumers think they know what a Local Authority search will reveal and may know about the Aughton or surrounding vicinity however most conveyancers will still prescribe one. One of the main reasons is that the local search LLC1 is the only place to reveal liabilities to the local council and this is more commonly the case with probate properties.

I am advised that the Con29 Enquiries in Aughton will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that councils are now in the process of identifying polluted areas and recording these areas on registers – this is a process which will take a unknown period of time to deliver upon. Needless to say any land parcels listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

Why is a drainage search key if you want to extent or alter the property in Aughton? One of the indispensable results shows the location of any public sewer nearby the land parcel you are buying. This is significant because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the foundations more expensive.

General Conveyancing Tips

Remember there are more often than not one or more connect sales involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale or purchase.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time period in Aughton you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Aughton

Are you on the panel of Barclays Bank plc? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Aughton.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional costs can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is approximately £2500 but is can be more in unusual cases. Second, the lease usually contains a provision for the selling to pay a charge to the management company based on a % of the sale price which is mainly 2% although other formula may be used. The lease will need to be checked carefully.
