What is included in a local authority search covering Ault Hucknall? There are two parts to a local authority search – Local Land Charges search and CON29. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is in need of an improvement or renovation grant. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Do we need environmental searches in Ault Hucknall? Statutory laws have resulted in a clear-up scheme for contaminated properties. The basic position is that the polluter should remediate however where that party cannot be found (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an lease in Ault Hucknall you may find that you are liable for the cost of any clear-up through the service charge provisions of the lease.

Why is a Drainage & Water Enquiry important if you want to extent or alter the property in Ault Hucknall? One of the significant details shows a plan of of any public sewer close to the site you are interested in. This is important because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the build cost more.

General Conveyancing Tips

Remember there are often many linked sales involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale or purchase.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a estimate what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their fees disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the time in Ault Hucknall you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Ault Hucknall

Are you able to oversee a mortgage with Melton Mowbray Building Society in Ault Hucknall? Yes we are on the mortgage Panel for this lender.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Ault Hucknall.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Revenue is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main home. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional payments can we anticipate? We cannot give you all the expenses up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is around £300 but is can be higher in unusual cases. Second, the lease may contains a clause for the assignor to pay a fee to the freeholder based on a percentage of the market value which is often 1% although other formula may be used. The lease will need to be checked carefully.
