What is included in a local authority search covering Aunby? There are two parts to a local authority search – Local Land Charge Register search and CON29. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the land is in need of an improvement or renovation grant. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Is there a need environmental investigations in Aunby? Statutory legislation have resulted in a clear-up system for contaminated land. The basic position is that the polluter should clean up however where that party disappears (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the existing owner (who could be you). Even if you are purchasing an leasehold in Aunby you may find that you are liable for the cost of any clean-up through the maintenance charge provisions of the lease.

Why is a Drainage & Water Enquiry decisive if you want to extent or alter the house in Aunby? One of the vital replies shows information of any public sewer on the property you are purchasing. This is worth knowing because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the foundations more expensive.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your home to take about 2 to 3 months.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your sale and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time scale in Aunby you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional payments can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing responses often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is approximately £2500 but is can be higher in unusual cases. Second, the lease could contains a provision for the assignor to pay a charge to the landlord based on a % of the market value which is often 2% although other formula may be used. The lease will need to be checked carefully.
