Searches on my Conveyancing Quote

What is included in a local authority search covering Avebury? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the title is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is in need of an improvement or renovation grant. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Do you recommend that I ask for a Environmental search on the property that we are buying in Avebury? Yes we including this in our quote. We would always recommend an environmental check on the land you intend to purchase which is available from a number of search providers including Future Climate. The environmental enquiry results provide details of present and past environmental risks together with a statement from an environmental expert confirming whether or not the site, based upon the information revealed by the search, is likely to be designated contaminated land by the council.

Why is a a CON29DW salient if you want to extent or alter the land in Avebury? One of the key details shows information of any public sewer nearby the house you are buying. This is worth knowing because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the extension more expensive.

General Conveyancing Tips

There is invariably mortgage finance to arrange and it should be noted that a conveyancer cannot rely on a “nod and a wink” by mortgage broker or anyone else. The conveyancer should have sight of your official written mortgage offer in order that they may (i) be sure that you are getting the advance you need and be able to check that you can comply with any special conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all outlays needed to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Avebury some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Avebury

Are you able to oversee a mortgage with West Bromwich Building Society in Avebury? Yes we are on the mortgage Panel for this lender.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Avebury.

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain procedures to ensure release of those ISAs including any bonus. If you complete the estimate you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to three hundred thousand pounds. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

I am the administrators of my parents estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our costs remain the same as our standard quote for this type of Seller.

About Avebury.

Avebury () is a Neolithic henge monument containing three stone circles, around the village of Avebury in Wiltshire, in southwest England. One of the best known prehistoric sites in Britain, it contains the largest megalithic stone circle in the world. It is both a tourist attraction and a place of religious importance to contemporary pagans.

Constructed over several hundred years in the Third Millennium BC, during the Neolithic, or New Stone Age, the monument comprises a large henge (a bank and a ditch) with a large outer stone circle and two separate smaller stone circles situated inside the centre of the monument. Its original purpose is unknown, although archaeologists believe that it was most likely used for some form of ritual or ceremony. The Avebury monument is a part of a larger prehistoric landscape containing several older monuments nearby, including West Kennet Long Barrow, Windmill Hill and Silbury Hill.

By the Iron Age, the site had been effectively abandoned, with some evidence of human activity on the site during the Roman period. During the Early Middle Ages, a village first began to be built around the monument, eventually extending into it. In the Late Medieval and Early Modern periods, local people destroyed many of the standing stones around the henge, both for religious and practical reasons. The antiquarians John Aubrey and William Stukeley, however, took an interest in Avebury during the 17th century, and recorded much of the site before its destruction. Archaeological investigation followed in the 20th century, led primarily by Alexander Keiller, who oversaw a project which reconstructed much of the monument.

Avebury is owned and managed by the National Trust. It has been designated a Scheduled Ancient Monument, as well as a World Heritage Site, in the latter capacity being seen as a part of the wider prehistoric landscape of Wiltshire known as Stonehenge, Avebury and Associated Sites.
