How long do Local Authority search searches take? The time for a Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our local searches LLC1 searches via a website some searches are still processed administered manually by the council. Also the search ETA can be affected by seasonal demand levels and local council staffing levels.

Why do we need environmental searches in Aveton Gifford? Statutory rules have resulted in a clear-up scheme for polluted areas. The basic position is that the polluter should fix the problem however where that party is missing (for example because the work was done some time ago or the company has gone into bankruptcy the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an flat in Aveton Gifford you may find that you are liable for the cost of any clean-up through the maintenance charge provisions of the lease.

General Conveyancing Tips

Remember there are commonly many related transactions involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all costs needed to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Aveton Gifford some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional fees can we anticipate? We cannot give you all the expenses up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is approximately £200-300 but is can be higher in extreme cases. Second, the lease could contains a agreement for the outgoing to pay a payment to the landlord based on a % of the market value which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.
