Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the land you are purchasing and might not show land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local council covering Axmouth. Usually, you can search most planning applications on the planning departments website by postcode or by map search).

I am told that the local Search in Axmouth will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that Local Authorities are now in the process of finding contaminated areas and recording these land on registers – this is a process which will take a many years to finish. Needless to say any sites named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local Search are likely to be incomplete.

What is a a CON29DW ? A a CON29DW confirms to a future purchaser that the property they are buying is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Axmouth which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading trading down and have a lot of items to clear. You can speed the process if it is your first purchase. You may be able to exchange and complete on the same day. However your instructions depend on what  others in the chain will allow.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the time in Axmouth you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Axmouth

Are you on the panel of M&S Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Help to Buy ISAs in Axmouth? Yes we are on the panel so we can deal with Help to Buy ISAs.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between three hundred thousand pounds and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main residence within 3 years.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold what additional fees can we anticipate? We cannot give you all the figures up front in our on line quote. The costs charged by landlords and managing agents will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is approximately £300 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into 2 leaseholds.
