General Conveyancing Tips

How long does conveyancing take? For relatively straightforward sale or purchase, expect the conveyancing of your property to take between 2 to 3 months.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a home buyer makes is not checking the plan properly. It is a good idea to visit the site to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often consumers mistakenly think that a piece of land at the side or rear of the home is theirs, only to later discover that the legal title to the property doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all bills necessary to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ayle some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Ayle

Are you able to conduct a mortgage with Monmouthshire Building Society in Ayle? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Help to Buy ISAs in Ayle? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Revenue is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main house. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40k. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional disbursements can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing responses often in a form called LPE1. The charge for this varies from organisation to organisation often it is approximately £200 but is can be more in rare cases. Second, the lease may contains a mechanism for the assigning to pay a fee to the freeholder based on a % of the sale price which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
