What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not cover developments next door or located a short distance away. Usually, you can search most planning applications on the planning departments website by postcode or by map search).

When we ask for an Environmental check on the property mentioned on the conveyancing quote for the property in Ayle what will it reveal? The search provides data of present and past contamination risks together with a certificate from an environmental expert confirming whether or not the site would be classified contaminated land by the local council. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area with high radon readings.

What is a a CON29DW ? A drainage search confirms to a new purchaser that the land parcel they are acquiring is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Ayle which are rural as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Thank you Mouzzam and Tricia were very helpful and professional throughout the purchase process. Whenever they got a new piece of information or documentation they quickly turned it around and kept us up to date with the implications. They were also very approachable, replying to our questions as we went through the process. Would recommend.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

There is more often than not mortgage finance to apply for and it should be noted that a solicitor cannot rely on a “nod and a wink” by mortgage broker or anyone else. The conveyancer must generally have sight of your official written offer of mortgage in order that she may (i) ensure that you are getting the money you need and verify that you can comply with any conditions of the mortgage offer imposed in the mortgage offer.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all outlays required to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ayle some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Ayle

Are you on the panel of TSB Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Ayle.

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA we are required to make certain checks to ensure release of those monies including any bonus. If you complete the online quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300k. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional disbursements can we anticipate? We cannot give you all the expenses up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing information often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £300 but is can be more in extreme cases. Second, the lease usually contains a mechanism for the selling to pay a payment to the freeholder based on a percentage of the sale price which is mainly 2% although other formula may be used. The lease will need to be checked carefully.
