Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental checks in Aylesbury? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any public sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that both of us ask for a Environmental enquiry on the property that we are buying in Aylesbury? Yes we including this in our quote. We would always recommend an environmental search on the ground you intend to purchase which is available from a number of search companies including Homecheck. The environmental enquiry results provide details of present and past environmental risks together with a statement from an environmental consultant confirming whether or not the site, based upon the information revealed by the search, is likely to be designated contaminated land by the London Borough/council.

Why is a water authority search essential if you want to extent or alter the house in Aylesbury? One of the significant results shows a plan of of any public sewer nearby the home you are buying. This is significant because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the foundations more costly.

Excellent experience, purchased my first property with ease. A big thanks to Mouzzam Yamin for staying on top of things and giving updates. Personally thought it would be a mission but KER made it possible.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

Remember there are often one or more related sales involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest purchase.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your sale and purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any written quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all bills needed to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Aylesbury some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Aylesbury

Are you able to conduct a mortgage with Fleet Mortgages Limited in Aylesbury? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Aylesbury.

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Taxman is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main house. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a buy to let in Aylesbury? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette what additional payments can we anticipate? We cannot give you all the expenses up front in our on line quote. The costs charged by freeholder and managing agents will vary for providing information packs often in a form called LPE1. The charge for this varies from company to company usually it is approximately £200-300 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two leaseholds.
