What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental searches in Aysgarth? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Remember there are always likely to be several linked transactions involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest purchase.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a consumer makes is not checking the plan properly. It is a best to visit the land to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often home buyers mistakenly think that a piece of land at the side or rear of the home is theirs,only to later discover that the legal title to the property doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays incurred to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Aysgarth some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. If we are selling a house in a retirement development what additional disbursements can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation on average it is approximately £2500 but is can be more in rare cases. Second, the lease could contains a mechanism for the assignor to pay a payment to the freeholder based on a % of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.
