Searches on my Conveyancing Quote

Do I need to get a local search LLC1 if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing home and do not necessarily have to conduct a search. Many such clients think they know what a local search LLC1 will reveal and may know about the Azerley or surrounding locale however most lawyers will still suggest one. One of the main reasons is that the local search LLC1 is the only place to reveal indebtedness to the council and this is more commonly the case with .

When we get an Environmental investigation on the property mentioned on the conveyancing quote for the property in Azerley what will it reveal? The search provides replies of present and past contamination risks together with a assessment from an environmental expert confirming whether or not the site could be officially names as contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area where radon readings are over 100 Bq m-3.

Why is a Drainage & Water Enquiry decisive if you want to extent or alter the land parcel in Azerley? One of the decisive results shows the location of any public sewer adjacent the site you are interested in. This is worth knowing because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the extension cost more.

General Conveyancing Tips

There is commonly mortgage finance to organise and it should be noted that a conveyancing lawyer cannot rely on a quick email by mortgage broker or anyone else. The conveyancing solicitor will need to have sight of your official written offer of mortgage in order that she may (i) verify that you are getting the money you need and be sure that you can comply with any offer conditions imposed in the mortgage terms.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time scale in Azerley you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

No because like all modern firms we rely on technology to assist us in our office to ensure that matters are dealt with speedily. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Azerley).

What SDLT will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300,000 and £500k will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat what additional fees can we anticipate? We cannot give you all the costs up front in our quote. The costs charged by freeholder and management companies will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £200 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 leaseholds.
