Searches on my Conveyancing Quote

Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they order when they are purchasing home and do not necessarily have to conduct a search. Many such consumers think they know what a Enquiries of the local authority search will reveal and may know about the Backworth or surrounding area however most lawyers will still advise one. One of the main reasons is that the Enquiries of the local authority search is the only place to reveal debts to the borough and this is more commonly the case with probate properties.

I believe that the official local Searches in Backworth will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that councils are now in the process of locating contaminated properties and recording these areas on registers – this is a process which will take a many years to deliver upon. Needless to say any ground listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Search are likely to be incomplete.

Why is a water authority search important if you want to extent or alter the site in Backworth? One of the significant replies shows a plan of of any public sewer nearby the land you are interested in. This is worth knowing because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the footings cost more.

used the services from KER for conveyancing my first property purchase. I would like to specially thank Mouzzam Yamin. He detailed every aspect of the process and was transparent in all the communication. The responses were quick and clear. The team behind were very friendly and professional. I would strongly recommend them and wouldn’t hesitate to use them again.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

Remember there are often one or more related transactions involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest purchase.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest law firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all bills needed to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Backworth some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is located and possibly also building insurance.

FAQs in Backworth

Are you able to conduct a mortgage with M&S Bank in Backworth? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Backworth.

If you are a first time buyer what additional expenses can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain actions to ensure release of those savings including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a second home in Backworth? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional payments can we anticipate? We cannot give you all the disbursements up front in our estimate. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing information often in a questionnaire called LPE1. The charge for this varies from company to company mainly it is around £2500 but is can be more in unusual cases. Second, the lease often contains a mechanism for the assigning to pay a charge to the landlord based on a percentage of the market value which is mainly 2% although other formula may be used. The lease will need to be checked carefully.
