Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the house you are purchasing and might not cover developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local planning department covering Bacton. Usually, you can search most planning applications on the planning departments website by postcode or by map search).

I am advised that the Con29 Searches in Bacton will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that councils are now in the process of identifying contaminated ground and recording these areas on registers – this is a process which will take a number of years to complete. Needless to say any ground included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Search are likely to be incomplete.

What is a a CON29 DW search ? A a CON29 DW search confirms to a new interested party that the house they are buying is connected to the mains water supply and mains drainage. This is particularly important in parts of Bacton which are not built up as there may be a a private drainage system.

Used them for conveyancing on my first property purchase and highly recommend. They have a very straightforward online illustration tool and the team behind it were always very friendly and professional. Thanks go to Mouzzam Yamin and his team. I wouldn’t hesitate to use them again. Thank you all for the great service.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on costs disguised as ‘disbursements’. Make sure that any quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the date in Bacton you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain actions to make sure release of those ISAs including any bonus. If you complete the quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional expenses can we anticipate? We cannot give you all the costs up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from company to company mainly it is around £2500 but is can be higher in rare cases. Second, the lease could contains a provision for the selling to pay a fee to the freeholder based on a % of the sale price which is mainly 2% although other formula may be used. The lease will need to be checked carefully.
