Searches on my Conveyancing Quote

Do I need to get a local search LLC1 if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing land and do not necessarily have to conduct a search. Many such clients think they know what a Enquiries of the local authority search will reveal and may know about the Badlesmere or surrounding vicinity however most conveyancing solicitors will still suggest one. One of the main reasons is that the local search LLC1 is the only place to reveal indebtedness to the borough and this is more commonly the case with .

Do you recommend that we order an Environmental check on the property that we are buying in Badlesmere? Yes we including this in our quote. We would always recommend an environmental search on the land parcel you intend to purchase which is available from a number of search companies including Groundsure. The environmental search results provide details of present and past environmental risks together with a report from an environmental consultant confirming whether or not the ground, based upon the information revealed by the search, could be officially names as contaminated land by the council.

Why is a water authority search vital if you want to extent or alter the site in Badlesmere? One of the important replies shows a plan of of any public sewer within the property you are buying. This is important because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the design more expensive.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a buyer makes is not checking the plan properly. It is a good idea to go to the property to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often consumers mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to later discover that the legal title to the house doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time in Badlesmere you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Badlesmere

Are you on the panel of Virgin Money? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Badlesmere.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no SDLT. If you are paying between £300,000 and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a second home in Badlesmere? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional expenses can we anticipate? We cannot give you all the expenses up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from company to company often it is around £300 but is can be higher in unusual cases. Second, the lease often contains a agreement for the assigning to pay a fee to the management company based on a percentage of the sale price which is sometimes 2% although other formula may be used. The lease will need to be checked carefully.
