Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the house you are purchasing and might not cover developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local authority covering Badsey. Usually, you can search most planning applications on the web by postcode or by map search).

Do we need environmental enquiries in Badsey? Statutory rules have resulted in a remediation scheme for contaminated land parcels. The basic position is that the polluter should pay however where that party disappears (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an flat in Badsey you may find that you are liable for the cost of any clean-up through the service charge provisions of the lease.

Why is a drainage search salient if you want to extent or alter the house in Badsey? One of the critical replies shows the location of any public sewer within the site you are purchasing. This is important because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the foundations cost more.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

No delays and completed very quickly. Would absolutely use again and would recommend to others. I came across this firm while researching conveyancing issues online, and they had a very informative blog. I have completed the purchase within 3 months without any issues. Mouzzam and Tricia at KER were great. Always quick to reply to my emails and processed paperwork very quickly in relation to my house purchase. Their service was very professional and I would use again. Fantastic service, professional and competent.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your house to take possibly eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your transaction and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their legal fees disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills necessary to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Badsey some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

No because like all modern practices we depend on technology to assist us in our work to ensure that matters are dealt with expeditiously. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Badsey).

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain steps to ensure release of those funds including any bonus. If you complete the quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300,000. If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main residence within 36 months.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a flat what additional payments can we anticipate? We cannot give you all the disbursements up front in our on line quote. The costs charged by landlords and managing agents will vary for providing responses often in a form called LPE1. The charge for this varies from organisation to organisation usually it is around £2500 but is can be higher in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple leaseholds.
