Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not cover developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your borough council covering Baffins. Usually, you can search most planning applications on line by postcode or by map search).

Is there a need environmental investigations in Baffins? Statutory laws have resulted in a clean-up scheme for contaminated areas. The basic position is that the polluter should clear-up however where that party cannot be found (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the current owner (who could be you). Even if you are purchasing an lease in Baffins you may find that you are liable for the cost of any clear-up through the maintenance charge provisions of the lease.

Why is a water authority search important if you want to extent or alter the land parcel in Baffins? One of the critical results shows a map of any public sewer on the land you are purchasing. This is worth knowing because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the addition more costly.

General Conveyancing Tips

There is often a mortgage to organise and it should be noted that a solicitor cannot rely on a “nod and a wink” by mortgage broker or anyone else. The conveyancing solicitor will need to have sight of your official written offer of mortgage in order that she may (i) be sure that you are getting the advance you need and verify that you can comply with any offer conditions imposed in the facility letter.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all expenses needed to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Baffins some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Baffins

Are you on the panel of Godiva Mortgages Ltd? Yes we act for all major lenders and many smaller lenders.

We note that you do not have an office in Baffins? Is this a problem? No because like all modern law firms we depend on technology to assist us in our work to ensure that matters are dealt with rapidly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Baffins).

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no SDLT. If you are paying between three hundred thousand pounds and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

We are administrators of my fathers estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our costs remain the same as quoted for this type of Seller.

About Baffins.

Baffins is an administrative district of Portsmouth, England, located on the eastern side of Portsea Island. The district is mainly composed of 1930s housing. The population of the Portsmouth ward at the 2011 Census was 15,121.

Before the area became developed for housing, it had been occupied by a farm of the same name. This farm had a history stretching back to the 12th century. The only surviving remnant of the rural past is Baffins Pond and the adjoining Tangier Field – a large open space between Baffins Pond and Portsmouth College at the eastern end of the field.
