Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such customers think they know what a Official Local Authority search will reveal and may know about the Bagby or surrounding vicinity however most conveyancing solicitors will still suggest one. One of the main reasons is that the local search LLC1 is the only place to reveal debts to the Local Authority and this is more commonly the case with probate properties.

Is there a need environmental investigations in Bagby? Statutory rules have resulted in a remediation system for polluted ground. The basic position is that the polluter should clear-up however where that party cannot be found (for example because the work was done some time ago or the company has gone into liquidation the liability for clean-up costs passes to the existing owner (who could be you). Even if you are purchasing an maisonette in Bagby you may find that you are liable for the cost of any clean-up through the maintenance charge provisions of the lease.

What is a Drainage & Water Enquiry ? A a CON29 DW search confirms to a new owner that the property they are purchasing is connected to the mains water supply and mains drainage. This is particularly significant in parts of Bagby which are rural as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading buying down and have a lot of items to get rid of. You can quicken the process if it is a first time buy. You may be able to exchange and complete together. However your instructions depend on what  others in the chain will comply with.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a estimate what disbursements apply to your sale and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any estimates you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all costs needed to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bagby some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Bagby

Are you able to handle a mortgage with Monmouthshire Building Society in Bagby? Yes we are on the mortgage Panel for this lender.

Are you able to deal with Help to Buy ISAs in Bagby? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your solicitor are required to make certain steps to ensure release of those savings including any bonus. If you complete the quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main house within three years.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette what additional payments can we anticipate? We cannot give you all the figures up front in our quote. The costs charged by landlords and management companies will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from company to company broadly it is around £200 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple flats.
