Searches on my Conveyancing Quote

Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a house and do not necessarily have to conduct a search. Many such buyers think they know what a Enquiries of the local authority search will reveal and may know about the Bagendon Village or surrounding vicinity however most conveyancers will still advise one. One of the main reasons is that the Official Local Authority search is the only place to reveal indebtedness to the local council and this is more commonly the case with properties where the owner has gone into a home.

I am advised that the Land Charges Enquiries in Bagendon Village will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that Local Authorities are now in the process of locating polluted properties and recording these sites on registers – this is a process which will take a unknown period of time to finish. Needless to say any land parcels named within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Searches are likely to be incomplete.

What is a Drainage & Water Enquiry ? A a CON29DW confirms to a new purchaser that the property they are interested in is connected to the mains water supply and mains drainage. This is particularly significant in parts of Bagendon Village which are country as there may be a a private drainage system.

General Conveyancing Tips

There is frequently mortgage finance to apply for and it should be noted that a conveyancing solicitor cannot rely on a “nod and a wink” by mortgage broker or anyone else. The conveyancing lawyer should have sight of your formal written offer of mortgage in order that he may (i) be able to check that you are getting the advance you need and be able to check that you can comply with any offer conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your matter and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on costs disguised as ‘disbursements’. Make sure that any quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all expenses required to repair the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bagendon Village some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Stamp Office is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional fees can we anticipate? We cannot give you all the expenses up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing responses often in a form called LPE1. The charge for this varies from organisation to organisation usually it is around £200 but is can be higher in rare cases. Second, the lease may contains a provision for the selling to pay a payment to the freeholder based on a % of the market value which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.
