Searches on my Conveyancing Quote

Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing a house and do not necessarily have to conduct a search. Many such customers think they know what a local search LLC1 will reveal and may know about the Baggrow or surrounding area however most lawyers will still suggest one. One of the main reasons is that the Enquiries of the local authority search is the only place to reveal monies due to the borough and this is more commonly the case with probate properties.

Why do we need environmental enquiries in Baggrow? Statutory legislation have resulted in a remediation scheme for polluted properties. The basic position is that the polluter should fix the problem however where that party cannot be found (for example because the work was done some time ago or the company has gone into liquidation the liability for clean-up costs passes to the existing owner (who could be you). Even if you are purchasing an leasehold in Baggrow you may find that you are liable for the cost of any remediation through the service charge provisions of the lease.

Why is a a CON29 DW search vital if you want to extent or alter the property in Baggrow? One of the decisive replies shows information of any public sewer within the home you are purchasing. This is important because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the addition more costly.

General Conveyancing Tips

Remember there are more often than not several linked sales involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest sale.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a home buyer makes is not checking the plan properly. It is a best to go to the land to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often customers mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to find out that the legal title to the site doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all outlays necessary to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Baggrow some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Baggrow

Are you able to handle a mortgage with Nationwide Building Society in Baggrow? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in Baggrow? Is this a issue? No because like all modern law firms we count on technology to assist us in our practice to ensure that matters are dealt with swiftly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Baggrow).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between three hundred thousand pounds and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

We are administrators of our parents estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.

About Baggrow.

Baggrow is a small village situated north of the Lake District National Park in the English county of Cumbria, historically within Cumberland.

In many parts of the village views of England’s 4th highest peak Skiddaw, standing 931 metres (3053 ft) above sea level, can be seen to the south east, some 9.5 mi (15 km) away.

The village is in the parliamentary constituency of Workington, Sue Hayman is the Member of parliament.

For Local Government purposes it is in the Allhallows & Waverton Ward of Allerdale Borough Council and the Aspatria Ward of Cumbria County Council.

Baggrow does not have its own parish council, instead it is part of Allhallows Parish Council. The Parish of Allhallows incorporates the three villages of Baggrow, Fletchertown and Watch Hill, together with the area of Mealsgate known as Pine Grove.

Baggrow railway station was a stop along the Bolton Loop of the Maryport and Carlisle Railway which used to run through the village serving the Brayton Knowle Colliery here, and the mine at nearby Mealsgate. The line has been dismantled but evidence of its existence and its use can be seen along the route.
