General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your property to take about 2 to 3 months.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a consumer makes is not checking the plan properly. It is a best to visit the land parcel to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the home is theirs, only to find out that the legal title to the house doesn’t include this area. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all outlays incurred to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bagthorpe some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is situated and possibly also building insurance.

FAQs in Bagthorpe

Are you on the panel of Royal Bank of Scotland? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Bagthorpe.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty . If you are paying between £300,000 and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional payments can we anticipate? We cannot give you all the expenses up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing information often in a questionnaire called LPE1. The charge for this varies from company to company often it is approximately £200 but is can be more in extreme cases. Second, the lease could contains a agreement for the outgoing to pay a charge to the landlord based on a percentage of the market value which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.
