Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental investigations in Balsall Common? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any public sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do we need environmental searches in Balsall Common? Statutory legislation have resulted in a clear-up system for contaminated land parcels. The basic position is that the polluter should clean up however where that party disappears (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the existing owner (who could be you). Even if you are purchasing an maisonette in Balsall Common you may find that you are liable for the cost of any clean-up through the maintenance charge provisions of the lease.

What is a a CON29DW ? A a CON29DW confirms to a prospective owner that the home they are interested in is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Balsall Common which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your sale and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time scale in Balsall Common you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Balsall Common

Are you on the panel of Lloyds Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Balsall Common.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Revenue is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40k. If you press “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a maisonette what additional payments can we anticipate? We cannot give you all the disbursements up front in our on line quote. The costs charged by freeholder and managing agents will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation often it is approximately £2500 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two flats.

About Balsall Common.

Balsall Common is a large village in the Metropolitan Borough of Solihull, England. It is situated 7.5 miles (12.1 km) west of Coventry, 8 miles (13 km) east of Solihull and 15 miles (24 km) to the southeast of Birmingham, to which it serves as a prosperous commuter village. It is currently undergoing gradual suburbanisation and is increasingly considered as a small town in terms of its population. The name “Balsall” comes from the Anglo Saxon word “Baelle” meaning corner (or angle) of land, and “Heale” meaning a sheltered place

The village is split between the civil parishes of Balsall, which also includes Balsall Street, Temple Balsall, and Fen End, and had a population of 7,039 according to the 2011 census. It also lies on the Heart of England Way.

The village is of recent origin; most of the houses and shops were built in the 20th century. Previously, the village consisted of a couple of hamlets of about six to twelve houses each and a few scattered cottages – as this map of 1889 shows. In the 1930s, there began the development which linked these isolated buildings, but it was not until after World War II that the village really began to grow.

With its close proximity to the village of Meriden 3 miles (4.8 km) away, which until recently was long-believed to be the geographic centre of England, Balsall Common is perceived to be one of the furthest places from the UK coastline. In fact, Coton-in-the-Elms in south Derbyshire holds this designation, situated 23.5 miles (37.8 km) to the north. Nevertheless, Balsall Common’s secondary school is named the Heart of England School. The local primary school is named Balsall Common Primary School.

It is served by Berkswell railway station (actually in Balsall Common) on the Coventry-Birmingham line, and by bus to Solihull (service S2A/S2C).

Other nearby towns and villages include Knowle, Kenilworth, Warwick, Hampton-in-Arden, Berkswell, Barston, Honiley and Hatton.

Since the late-1990s, plans for a bypass, a large national supermarket and larger swathes of new housing have so far been circumvented. This is mainly due to Balsall Common being situated at the heart of the West Midlands green belt area known as the Meriden Gap, between Solihull and Coventry, and is thus subject to strict planning regulations. Therefore, the village/town has so far not witnessed rapid growth given its location, as residents had long-feared that the village would act as a population overspill centre for Coventry, Solihull and Birmingham. A new Tesco Metro store opened in December 2014 on Station Road.

Several Premiership and Championship footballers live (and have lived) in Balsall Common, especially those playing with Birmingham City, Aston Villa and Coventry City. These include John Sillett, Trond Egil Soltvedt, Trevor Francis in the late 1970s, Lee Carsley and Robbie Keane. Other famous sporting residents include, former England cricket captain Bob Wyatt and Wimbledon ladies single champion Maud Watson. Former England international goalkeeper Peter Shilton briefly lived in the village from late-1995 to early 1996, before moving to nearby Burton Green.[citation needed].
Another notable resident is Paddy Doyle, who formerly held numerous fitness and endurance world records. Neil Back, Rugby Union, Leicester Tigers British and Irish Lions also Lived in Balsall Common during his career in the 1990s – early 2000s
