Searches on my Conveyancing Quote

What is included in a local authority search covering Balsham? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Why do we need environmental checks in Balsham? Statutory laws have resulted in a remediation system for contaminated land parcels. The basic position is that the polluter should clean up however where that party cannot be found (for example because the work was done some time ago or the company has gone into bankruptcy the liability for clean-up costs passes to the existing owner (who could be you). Even if you are purchasing an lease in Balsham you may find that you are liable for the cost of any remediation through the service charge provisions of the lease.

Why is a water authority search decisive if you want to extent or alter the property in Balsham? One of the indispensable replies shows information of any public sewer within the site you are purchasing. This is worth knowing because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the foundations more expensive.

General Conveyancing Tips

Remember there are always likely to be many linked sales involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest purchase.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a client makes is not checking the plan properly. It is a best to go to the site to check that what is shown on the plan agrees with what you think you’re buying on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the property is theirs, only to find out that the legal title to the land parcel doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time in Balsham you should check with your lawyer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Balsham

Are you able to oversee a mortgage with Royal Bank of Scotland in Balsham? Yes we are on the mortgage Panel for this lender.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Balsham.

If you are a first time buyer what additional fees can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA we are required to make certain procedures to ensure release of those ISAs including any bonus. If you complete the online quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to three hundred thousand pounds. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main home within three years.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

I have obtained probate for our mother estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
