Searches on my Conveyancing Quote

Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing land and do not necessarily have to conduct a search. Many such purchasers think they know what a Official Local Authority search will reveal and may know about the Balsham or surrounding area however most conveyancing lawyers will still suggest one. One of the main reasons is that the Official Local Authority search is the only place to reveal debts to the borough and this is more commonly the case with properties where the owner has gone into a home.

When we obtain a Environmental investigation on the property mentioned on the conveyancing quote for the property in Balsham what will it reveal? The search provides results of present and past contamination risks together with a certificate from an environmental consultant confirming whether or not the site could be officially names as contaminated land by the local council. It may also reveal other information such as whether the property is within a flood plain area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and radon prone area.

Why is a a CON29DW key if you want to extent or alter the land parcel in Balsham? One of the essential details shows information of any public sewer adjacent the house you are buying. This is important because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the foundations more costly.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading buying down and have a lot of items to get rid of. You can speed the process if it is your first purchase. You may be able to exchange and complete together. However your instructions depend on what  others in the chain will allow.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a home buyer makes is not checking the plan properly. It is a best to visit the land to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often buyers mistakenly think that a piece of land at the side or rear of the land is theirs, only to later discover that the legal title to the site doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by a mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time scale in Balsham you should check with your solicitor. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Balsham

Are you able to manage a mortgage with First Direct in Balsham? Yes we are on the mortgage Panel for this lender.

We see that you do not have an office in Balsham? Is this a concern? No because like all modern law firms we rely on technology to assist us in our firm to ensure that matters are dealt with promptly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Balsham).

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA KER are required to make certain steps to facilitate release of those savings including any bonus. If you complete the estimate you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to three hundred thousand pounds. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional costs can we anticipate? We cannot give you all the figures up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a form called LPE1. The charge for this varies from company to company broadly it is approximately £200-300 but is can be higher in unusual cases. Second, the lease may contains a agreement for the assignor to pay a fee to the landlord based on a % of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.
