Searches on my Conveyancing Quote

How long do Enquiries of the local authority search searches take? The wait time for a local search LLC1 can vary significantly, from 24 hours to six weeks! Although we order all our Local Authority searches through an electronic search provider some searches are still processed completed manually by the Local Authority. Also the search wait time can be affected by seasonal demand levels and local council staffing levels.

I heard that the local Search in Bamber Bridge will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that Local Authorities are now in the process of identifying polluted sites and recording these sites on registers – this is a process which will take a an uncertain amount of time to complete. Needless to say any property entered within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Searches are likely to be incomplete.

What is a drainage search ? A drainage search confirms to a future buyer that the home they are interested in is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Bamber Bridge which are not built up as there may be a a private drainage system.

General Conveyancing Tips

Remember there are often a few connect sales involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest transaction.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a quote what disbursements apply to your sale and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by a mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the time period in Bamber Bridge you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Bamber Bridge

Are you on the panel of M&S Bank? Yes we act for all major lenders and many smaller lenders.

We are aware that you do not have an office in Bamber Bridge? Is this a concern? No because like all modern law firms we rely on technology to assist us in our firm to ensure that matters are dealt with rapidly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Bamber Bridge).

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no SDLT. If you are paying between £300,000 and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a buy to let in Bamber Bridge? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

I am the executor of my family estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
