Searches on my Conveyancing Quote

How long do local search LLC1 searches take? The ETA for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our Local Authority searches via a website some searches are still processed handled manually by the local council. Also the search timescale can be affected by seasonal demand levels and council staffing levels.

I believe that the local Searches in Bampton will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that Local Authorities are now in the process of identifying polluted areas and recording these sites on registers – this is a process which will take a unknown period of time to complete. Needless to say any ground included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

What is a a CON29DW ? A a CON29DW confirms to a prospective buyer that the house they are acquiring is connected to the mains water supply and mains drainage. This is particularly important in parts of Bampton which are countryside as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

I can honestly say that Mark Sadler is the best property solicitor I have ever experienced and I have dealt with many over the years. I found him on google after 2 days of searching for the answer to a very complicated freehold/leasehold problem. When I called him about our dilemma, Mark knew exactly how to tackle it and he did so with great ease. He dealt with every communication promptly, courteously and efficiently. I could not have asked for more and I am extremely grateful to him for taking on our case. I would not hesitate to recommend him to anyone with a property related legal issue. Thank you again.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

There is more often than not mortgage finance to arrange and it should be noted that a solicitor cannot rely on a oral confirmation by mortgage broker or anyone else. The Solicitor must generally have sight of your formal written offer of mortgage in order that he may (i) be sure that you are getting the advance you need and ensure that you can comply with any special conditions imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all costs incurred to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bampton some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Bampton

Are you able to conduct a mortgage with Godiva Mortgages Ltd in Bampton? Yes we are on the mortgage Panel for this lender.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Bampton.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no Stamp Duty . If you are paying between £300k and £500k will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main property within 36 months.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

We have obtained Letters of Administration for our mother estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
