Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they ask us to order when they are purchasing a property and do not necessarily have to conduct a search. Many such consumers think they know what a Official Local Authority search will reveal and may know about the Banwell Castle or surrounding vicinity however most conveyancing solicitors will still counsel for one. One of the main reasons is that the Local Authority search is the only place to reveal liabilities to the council and this is more commonly the case with probate properties.

Do you recommend that both of us ask for an Environmental check on the property that we are buying in Banwell Castle? Yes we including this in our quote. We would always recommend an environmental search on the land parcel you intend to purchase which is available from a number of search companies including Argyll Site Solutions. The environmental check results provide details of present and past environmental risks together with a assessment from an environmental expert confirming whether or not the ground, based upon the information revealed by the search, would be officially names as contaminated land by the local council.

What is a a CON29 DW search ? A a CON29DW confirms to a future owner that the house they are acquiring is connected to the mains water supply and mains drainage. This is particularly significant in parts of Banwell Castle which are rural as there may be a a private drainage system.

General Conveyancing Tips

There is frequently a mortgage loan to organise and it should be noted that a solicitor cannot rely on a “nod and a wink” by mortgage broker or anyone else. They must generally have sight of your official written offer of mortgage in order that she may (i) verify that you are getting the money you need and be able to check that you can comply with any special conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a estimate what disbursements apply to your sale and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any written quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills incurred to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Banwell Castle some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Banwell Castle

Are you on the panel of Barclays Bank UK plc? Yes we act for all major lenders and many smaller lenders.

Are you able to manage Help to Buy ISAs in Banwell Castle? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Revenue is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main residence. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

We are executors of our family estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our costs remain the same as our standard quote for this type of Seller.
