Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental investigations in Banwell? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I am advised that the local authority Search in Banwell will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that councils are now in the process of finding polluted areas and recording these land on registers – this is a process which will take a unknown period of time to accomplish. Needless to say any ground named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Search are likely to be incomplete.

Apart from showing that the land in Banwell is connected to the mains water supply and mains drainage what other information does a a CON29 DW search show? A drainage search verifies to a prospective buyer that the house they are buying does not need a “build over consent” because the previous owner has constructed an addition to the house within three metres of a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

There is always likely to be a mortgage offer to obtain and it should be noted that a conveyancing lawyer cannot rely on a informal confirmation by mortgage broker or anyone else. They should have sight of your official written mortgage offer in order that she may (i) be able to check that you are getting the advance you need and be able to check that you can comply with any special conditions imposed in the mortgage offer.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all expenses incurred to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Banwell some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Banwell

Are you on the panel of Barclays Bank plc? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Help to Buy ISAs in Banwell? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an individual who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main residence. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional expenses can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional payments can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from company to company mainly it is approximately £2500 but is can be higher in extreme cases. Second, the lease may contains a clause for the assigning to pay a charge to the landlord based on a percentage of the sale price which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
