Whilst it is correct that Local Authorities are now in the process of finding polluted sites and recording these properties on registers – this is a process which will take a unknown period of time to finish. Needless to say any land included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Searches are likely to be incomplete.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading trading down and have a lot of items to clear. You can quicken the process if it is your first purchase. You may be able to exchange and complete on the same day. However your choice depend on what  others in the chain will comply with.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all costs required to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barbican some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Barbican

Are you on the panel of M&S Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Help to Buy ISAs in Barbican? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Inland Revenue is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main residence. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a flat what additional costs can we anticipate? We cannot give you all the costs up front in our on line quote. The costs charged by freeholder and managing agents will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is around £200-300 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 maisonettes.

About Barbican.

A barbican (from Old French: barbacane) is a fortified outpost or gateway, such as at an outer defense perimeter of a city or castle, or any tower situated over a gate or bridge which was used for defensive purposes.

In the Middle Ages, barbicans were typically situated outside the main line of defenses, and were connected to the city walls with a walled road called the neck. In the 15th century, with the improvement in siege tactics and artillery, barbicans lost their significance. However, several barbicans were built well into the 16th century.

Fortified or mock-fortified gatehouses remained a feature of ambitious French and English residences well into the 17th century.

Fortifications in East Asia also feature similar high structures. In particular, gates in Chinese city walls were often defended by an additional “archery tower” in front of the main gatehouse, with the two towers connected by walls extending out from the main fortification. Literally called “jar walls”, they are often referred to as “barbicans” in English.
