Searches on my Conveyancing Quote

What is included in a local authority search covering Barbon? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The second part of the search – Enquiries of the local authority – supplies information relating to whether the roadway abutting the property is public or private, proposals for new major roads, rail schemes or building consents relating to the title. The responses can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Do we need environmental investigations in Barbon? Statutory rules have resulted in a clear-up scheme for polluted areas. The basic position is that the polluter should pay however where that party cannot be found (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an flat in Barbon you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

What is a a CON29DW ? A water authority search confirms to a future interested party that the house they are interested in is connected to the mains water supply and mains drainage. This is particularly important in parts of Barbon which are not built up as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

used the services from KER for conveyancing my first property purchase. I would like to specially thank Mouzzam Yamin. He detailed every aspect of the process and was transparent in all the communication. The responses were quick and clear. The team behind were very friendly and professional. I would strongly recommend them and wouldn’t hesitate to use them again.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

There is always likely to be a mortgage offer to apply for and it should be noted that a solicitor cannot rely on a oral confirmation by mortgage broker or anyone else. The Firm should have sight of your formal written mortgage offer in order that he may (i) ensure that you are getting the loan you need and be able to check that you can comply with any special conditions imposed in the mortgage offer.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a client makes is not checking the plan properly. It is a best to go to the site to check that what is shown on the plan agrees with what you think you’re buying on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the land is theirs, only to find out that the legal title to the land parcel doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the deeds for some times now although this was brought in at different times across the country. For the time period in Barbon you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

Are you able to manage Help to Buy ISAs in Barbon? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA we are required to make certain actions to make sure release of those ISAs including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300k. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a leasehold what additional fees can we anticipate? We cannot give you all the figures up front in our estimate. The costs charged by landlords and management companies will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is approximately £200 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into a couple leaseholds.
