What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental searches in Barbrook? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Remember there are more often than not one or more linked purchases involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest link in the chain.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a estimate what disbursements apply to your sale and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on costs disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional fees can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £200-300 but is can be higher in rare cases. Second, the lease could contains a mechanism for the selling to pay a fee to the freeholder based on a percentage of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.

About Barbrook.

Barbrook is a village in Devon, England. It is close to the source of the West Lyn River.

The village post office and shop closed on 27 September 2008. The listed former school house is beside the A39. There is currently a petrol station and shop at the junction of the A39 and B3234.

Barbrook was affected by the 1952 Lynmouth Flood. A sign showing the height of the floodwater can be seen in Cherrybridge and there is a memorial garden on the site of 2 houses which fell into the river. The original stone arched road bridge on the site of the current foot bridge was destroyed and a new bridge was constructed further upstream, a house was demolished to make way for the new roadway. The river channel was enlarged to prevent future problems.

In the early part of the 1900s it was mostly surrounded by conifer plantations, these were felled and have now been replaced by deciduous woodland.

Barbrook means “Babbling Brook”, in 1650 it was known as Babbroke.
