Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental enquiries in Barcheston? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any public sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

When we get a Environmental investigation on the property mentioned on the conveyancing quote for the property in Barcheston what will it reveal? The search provides results of present and past pollution risks together with a assessment from an environmental consultant confirming whether or not the ground could be classified contaminated land by the council. It may also reveal other information such as whether the property is within a flood area area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and radon prone area.

Why is a water authority search fundamental if you want to extent or alter the land parcel in Barcheston? One of the indispensable results shows the location of any public sewer close to the property you are interested in. This is important because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the extension cost more.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading buying down and have a lot of items to get rid of. You can prompt the process if it is your first purchase. You may be able to exchange and complete on the same day. However your desire depend on what  others in the chain will agree to.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the time period in Barcheston you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Barcheston

Are you on the panel of Coventry Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Barcheston.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty . If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I am the executor of our mother estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our legal costs remain the same as our standard quote for this type of Seller.

About Barcheston.

Barcheston is a village in the civil parish of Barcheston and Willington and the Stratford district of Warwickshire, England. The village is on the east bank of the River Stour, opposite Shipston-on-Stour.

The parish, administered at its lowest level by the Barcheston and Willington Parish Meeting, is in the Ettington ward of the district council. According to the 2001 census parish population was 134, increasing to 141 at the 2011 Census.

Ralph Ardern inherited the manor of Barcheston between 1382 (the death of his father, Henry de Ardern) and 1408 (the death of his mother). Whether or not he was ever resident is unknown.

The first English tapestry factory was the Sheldon Looms, established here in Warwickshire by William Sheldon about the middle of the 16th century. The tapestries produced here compare well with the finest contemporary Flemish weavings. Some of these consisted of large tapestry maps of English counties.

An outline of Barcheston’s history can be found in the Victoria County History, Warwickshire.
