What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not reveal land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local council covering Bardsea. Usually, you can search most planning applications on line by postcode or by map search).

The basic position is that the polluter should remediate however where that party is missing (for example because the work was done some time ago or the company has gone into a winding up the liability for clear-up costs passes to the current owner (who could be you). Mouzzam Yamin has just completed the sale of a house for us and we found him to be professional and helpful at all times. We would happily use this company again and would recommend them to others.

General Conveyancing Tips

There is invariably mortgage finance to apply for and it should be noted that a conveyancer cannot rely on a quick email by mortgage broker or anyone else. They should have sight of your final written offer of mortgage in order that they may (i) be able to check that you are getting the advance you need and be sure that you can comply with any conditions of the mortgage offer imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time in Bardsea you should check with your solicitor. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Bardsea

Are you on the panel of Melton Mowbray Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Help to Buy ISAs in Bardsea? Yes we are on the panel so we can deal with Help to Buy ISAs.

What SDLT will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300,000 and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main house within three years.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a maisonette what additional costs can we anticipate? We cannot give you all the figures up front in our quote. The costs charged by landlords and management companies will vary for providing replies often in a form called LPE1. The charge for this varies from organisation to organisation usually it is approximately £2500 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into two leaseholds.
