General Conveyancing Tips

Remember there are commonly several connect sales involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest sale.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their legal fees disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the date in Barford St Michael you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a second home in Barford St Michael? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional expenses can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from company to company broadly it is approximately £200 but is can be more in rare cases. Second, the lease usually contains a mechanism for the outgoing to pay a charge to the freeholder based on a percentage of the sale price which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.

About Barford St Michael.

Barford St Michael is a village on the south bank of the River Swere in Oxfordshire, England, about 5 miles (8 km) south of Banbury.

The village is part of the civil parish of Barford St. John and St. Michael. Barford St Michael has sometimes been called Great Barford as it is much larger than the village of Barford St. John on the opposite bank of the Swere.

The bell tower and north doorway of Church of England parish church of St Michael are Norman. Much of the rest of the church was rebuilt in the 13th century in the Early English Gothic style. It is a Grade I listed building.

In August 1549 the vicar, James Webbe, was executed at Aylesbury for his part in leading a rising in protest at the abolition of the Latin liturgy and other religious reforms.

The village has one public house, the George Inn. It was built in 1697 and in the 20th century was a Hunt Edmunds tied house. There is also a farm shop. Woodworm Records Recording Studio is based in the village.
