Searches on my Conveyancing Quote

How long do Local Authority search searches take? The timescale for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Local Authority searches electronically some searches are still processed processed manually by the council. Also the search ETA can be affected by seasonal demand levels and council staffing levels.

I think that the local authority Search in Barholm will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that Local Authorities are now in the process of identifying polluted property and recording these land parcels on registers – this is a process which will take a many years to complete. Needless to say any ground listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Enquiries are likely to be incomplete.

What is a a CON29 DW search ? A a CON29 DW search confirms to a potential interested party that the land parcel they are acquiring is connected to the mains water supply and mains drainage. This is particularly significant in parts of Barholm which are rural as there may be a a private drainage system.

General Conveyancing Tips

There is more often than not a mortgage offer to obtain and it should be noted that a conveyancing solicitor cannot rely on a informal confirmation by mortgage broker or anyone else. He must generally have sight of your official written offer of mortgage in order that she may (i) be able to check that you are getting the loan you need and be able to check that you can comply with any lender’s conditions imposed in the mortgage loan.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a client makes is not checking the plan properly. It is a best to visit the land to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often home buyers mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to later discover that the legal title to the site doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time scale in Barholm you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Barholm

Are you on the panel of National Counties Building Society and Family Building Society ? Yes we act for all major lenders and many smaller lenders.

We note that you do not have an office in Barholm? Is this a concern? No because like all modern solicitors we count on technology to assist us in our office to ensure that matters are dealt with quickly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barholm).

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no Stamp Duty . If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main residence within 36 months.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette what additional disbursements can we anticipate? We cannot give you all the disbursements up front in our quote. The costs charged by landlords and management companies will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from company to company mainly it is approximately £2500 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two flats.

About Barholm.

Barholm is a village in the South Kesteven district of Lincolnshire, England. It is 2 miles (3 km) west from the A15 road, and 6 miles (10 km) south from Bourne.

Barholm is first recorded as “Berc(a)ham” in 1086; the name is from Old English beorg + hām or hamm and means “homestead or enclosure on a hill.”

Hereward (later known as Hereward the Wake) owned land in Barholm and the nearby village of Stow in the period before the Norman conquest in 1066.[citation needed]

The church received a new tower during the English Civil War and an inscription reads:

“Was ever such a thing
Since the Creation?
A new steeple built
In the time of vexation.”

Barholm is run through a Parish Meeting of its residents rather than a Parish Council, two District Councillors who represent Casewick Ward on South Kesteven District Council and a County Councillor representing Deepings West & Rural Division on Lincolnshire County Council. The current District Councillors elected in May 2011 and re-elected in 2015 are Kelham Cooke (Con) and Rosemary Trollope-Bellew (Con). The Lincolnshire County Councillor elected in 2017 is Rosemary Trollope-Bellew (Con).
