What is a Local Authority Search and why is it needed in Barking? Whilst this is to a lawyers and lenders an indispensable piece of the home buying process to home buyers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In limited cases the replies can be used to renegotiate your the purchase price or and may even make you pull out of from the buying.

When we get a Environmental investigation on the property mentioned on the conveyancing quote for the property in Barking what will it reveal? The search provides details of present and past pollution risks together with a statement from an environmental expert confirming whether or not the property might be designated contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flood plain area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area where radon readings are over 100 Bq m-3.

General Conveyancing Tips

How long does conveyancing take? For relatively typical sale or purchase, expect the conveyancing of your property to take on average eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a quote what disbursements apply to your sale and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their legal fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the date in Barking you should check with your lawyer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Barking

Are you on the panel of Cynergy Bank? Yes we act for all major lenders and many smaller lenders.

We are aware that you do not have an office in Barking? Is this a issue? No because like all modern law firms we depend on technology to assist us in our work to ensure that matters are dealt with quickly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barking).

If you are a first time buyer what additional fees can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain procedures to make sure release of those ISAs including any bonus. If you complete the estimate you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300k. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main home within 36 months.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

I have obtained Letters of Administration for my family estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
