Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the land you are purchasing and might not reveal developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local council covering Barking. Usually, you can search most planning applications on line by postcode or by map search).

Why do we need environmental investigations in Barking? Statutory laws have resulted in a clear-up system for contaminated ground. The basic position is that the polluter should fix the problem however where that party cannot be found (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an maisonette in Barking you may find that you are liable for the cost of any clean-up through the service charge provisions of the lease.

Why is a water authority search critical if you want to extent or alter the house in Barking? One of the key replies shows a plan of of any public sewer within the land parcel you are buying. This is worth knowing because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the footings more costly.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

We dealt with Mouzzam who was very quick at replying and managed to complete the property purchase in less than a month. I couldn’t recommend them enough. Great service Excellent service provided by Mouzzam Yamin. Very quick full responses to all contact made. Mouzzam handled everything extremely quickly and diligently on his end, and certainly put the other side’s conveyancer to shame. Would definitely use again in the future and recommend to friends / family if they need the service.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading trading down and have a lot of items to clear. You can prompt the process if it is your first buy. You may be able to exchange and complete simultaneously. However your option depend on what  others in the chain will comply with.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time in Barking you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Barking

Are you on the panel of Santander? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Help to Buy ISAs in Barking? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA this firm are required to make certain checks to ensure release of those ISAs including any bonus. If you complete the estimate you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300k. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main property within three years.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

I have obtained Letters of Administration for my fathers estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.
