Searches on my Conveyancing Quote

How long do Official Local Authority search searches take? The timescale for a local search LLC1 can vary significantly, from 24 hours to six weeks! Although we order all our local searches LLC1 searches via a website some searches are still processed managed manually by the local council. Also the search timescale can be affected by seasonal demand levels and local council staffing levels.

I am advised that the local Enquiries in Barkston Ash will show if the land is contaminated. Is that right? Not really. Whilst it is correct that Local Authorities are now in the process of identifying contaminated areas and recording these land parcels on registers – this is a process which will take a decades to finish. Needless to say any properties comprised within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

What is a a CON29 DW search ? A drainage search confirms to a new buyer that the land they are purchasing is connected to the mains water supply and mains drainage. This is particularly significant in parts of Barkston Ash which are farming areas as there may be a a private drainage system.

General Conveyancing Tips

There is always likely to be mortgage finance to organise and it should be noted that a conveyancing lawyer cannot rely on a quick email by mortgage broker or anyone else. The Solicitor must generally have sight of your official written mortgage offer in order that she may (i) be sure that you are getting the loan you need and be sure that you can comply with any conditions of the mortgage offer imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a estimate what disbursements apply to your transaction and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all outlays required to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barkston Ash some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Barkston Ash

Are you able to manage a mortgage with HSBC Bank plc in Barkston Ash? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in Barkston Ash? Is this a concern? No because like all modern firms we depend on technology to assist us in our work to ensure that matters are dealt with expeditiously. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barkston Ash).

If you are a first time buyer what additional expenses can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain procedures to make sure release of those monies including any bonus. If you complete the estimate you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300k. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

We have obtained Letters of Administration for our fathers estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our fees remain the same as quoted for this type of Seller.
