Searches on my Conveyancing Quote

How long do local search LLC1 searches take? The time for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Enquiries of the local authority search through our search provider’s website some searches are still processed completed manually by the Local Authority. Also the search wait time can be affected by seasonal demand levels and local council staffing levels.

When we order a Environmental search on the property mentioned on the conveyancing quote for the property in Barlborough what will it reveal? The search provides results of present and past contamination risks together with a report from an environmental consultant confirming whether or not the land might be classified contaminated land by the local council. It may also reveal other information such as whether the property is within a flooding area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon area.

What is a water authority search ? A a CON29 DW search confirms to a new owner that the land they are interested in is connected to the mains water supply and mains drainage. This is particularly important in parts of Barlborough which are countryside as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading trading down and have a lot of items to get rid of. You can quicken the process if it is your first purchase. You may be able to exchange and complete on the same day. However your instructions depend on what  others in the chain will comply with.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all expenses needed to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barlborough some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Taxman is an real person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a buy to let in Barlborough? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional payments can we anticipate? We cannot give you all the costs up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from company to company broadly it is approximately £200-300 but is can be more in rare cases. Second, the lease often contains a mechanism for the assigning to pay a fee to the freeholder based on a percentage of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.
