Searches on my Conveyancing Quote

What is included in a local authority search covering Barmby on the Marsh? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is public or private, proposals for new roads, railway schemes or building consents relating to the title. The results can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Do you recommend that both of us get a Environmental enquiry on the property that we are buying in Barmby on the Marsh? Yes we including this in our quote. We would always recommend an environmental check on the site you intend to purchase which is available from a number of search companies including Landmark. The environmental search results provide details of present and past environmental risks together with a report from an environmental expert confirming whether or not the site, based upon the information revealed by the search, would be designated contaminated land by the London Borough/council.

Why is a drainage search essential if you want to extent or alter the house in Barmby on the Marsh? One of the main results shows information of any public sewer nearby the land you are interested in. This is worth knowing because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the footings cost more.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading trading down and have a lot of items to get rid of. You can quicken the process if it is a first time buy. You may be able to exchange and complete together. However your choice depend on what  others in the chain will consent to.

Always check what you are acquiring? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a customer makes is not checking the plan properly. It is a good idea to go to the site to check that what is shown on the plan agrees with what you think you’re buying on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the property is theirs, only to later discover that the legal title to the property doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all expenses necessary to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barmby on the Marsh some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

FAQs in Barmby on the Marsh

Are you on the panel of The Mortgage Lender Limited? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Barmby on the Marsh? Is this a concern? No because like all modern firms we depend on technology to assist us in our work to ensure that matters are dealt with swiftly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barmby on the Marsh).

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Revenue is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main residence. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a flat what additional disbursements can we anticipate? We cannot give you all the costs up front in our on line quote. The costs charged by freeholder and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from organisation to organisation usually it is around £200-300 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into two leaseholds.
