Searches on my Conveyancing Quote

What is included in a local authority search covering Barnard Castle? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Why do we need environmental checks in Barnard Castle? Statutory laws have resulted in a clear-up scheme for contaminated properties. The basic position is that the polluter should fix the problem however where that party cannot be found (for example because the work was done some time ago or the company has gone into liquidation the liability for clean-up costs passes to the existing owner (who could be you). Even if you are purchasing an flat in Barnard Castle you may find that you are liable for the cost of any clean-up through the service charge provisions of the lease.

Why is a drainage search vital if you want to extent or alter the site in Barnard Castle? One of the significant results shows information of any public sewer within the land parcel you are buying. This is significant because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the design cost more.

General Conveyancing Tips

Remember there are frequently many connect transactions involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest link in the chain.

Always check what you are buying? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a home buyer makes is not checking the plan properly. It is a good idea to visit the land parcel to check that what is shown on the plan agrees with what you think you’re buying on site. All too often customers mistakenly think that a piece of land at the side or rear of the site is theirs, only to later discover that the legal title to the land doesn’t include this area. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills needed to maintain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barnard Castle some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is situated and possibly also building insurance.

FAQs in Barnard Castle

Are you on the panel of HSBC Bank plc? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Help to Buy ISAs in Barnard Castle? Yes we are on the panel so we can deal with Help to Buy ISAs.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no SDLT. If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of SDLT. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a flat what additional payments can we anticipate? We cannot give you all the disbursements up front in our quote. The costs charged by freeholder and management companies will vary for providing information often in a questionnaire called LPE1. The charge for this varies from organisation to organisation broadly it is approximately £200-300 but is can be higher in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into 2 flats.

About Barnard Castle.

Barnard Castle (locally [ˈbɑːnəd ˈkæsəl], BAH-nəd KASS-əl) is a market town in Teesdale, County Durham, England. It is named after the castle around which it was built. It is the main settlement in the Teesdale area, and a popular tourist destination. The Bowes Museum has what is considered to be the best collection of European fine and decorative arts in the North of England, housed in a 19th-century French-style chateau. Its most famous exhibit is the 18th-century Silver Swan automaton, and its artworks include paintings by Goya and El Greco.

Barnard Castle sits on the north bank of the River Tees, opposite Startforth and 21 miles (34 km) south-west of the county town of Durham. Nearby towns include Bishop Auckland to the north-east, Darlington to the east and Richmond in North Yorkshire to the south-east.

Barnard Castle’s largest single employer is GlaxoSmithKline, which has a manufacturing facility on the town outskirts.
