Searches on my Conveyancing Quote

Do I need to get a local search LLC1 if I’m a cash buyer? Cash buyers do have a choice on what they ask us to order when they are purchasing home and do not necessarily have to conduct a search. Many such customers think they know what a Enquiries of the local authority search will reveal and may know about the Barnardiston or surrounding area however most solicitors will still suggest one. One of the main reasons is that the Local Authority search is the only place to reveal debts to the local council and this is more commonly the case with probate properties.

I believe that the official local Searches in Barnardiston will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that councils are now in the process of finding contaminated property and recording these properties on registers – this is a process which will take a many years to deliver upon. Needless to say any land comprised within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

What is a a CON29DW ? A Drainage & Water Enquiry confirms to a prospective purchaser that the land parcel they are acquiring is connected to the mains water supply and mains drainage. This is particularly significant in parts of Barnardiston which are rural as there may be a a private drainage system.

General Conveyancing Tips

Remember there are invariably a few linked sales involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest purchase.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the time in Barnardiston you should check with your solicitor. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

Are you able to manage Help to Buy ISAs in Barnardiston? Yes we are on the panel so we can deal with Help to Buy ISAs.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no Stamp Duty . If you are paying between three hundred thousand pounds and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of SDLT. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40k. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a flat what additional fees can we anticipate? We cannot give you all the costs up front in our estimate. The costs charged by freeholder and management companies will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is approximately £2500 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two flats.
