Searches on my Conveyancing Quote

Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they ask us to order when they are purchasing land and do not necessarily have to conduct a search. Many such consumers think they know what a Official Local Authority search will reveal and may know about the Barnardiston or surrounding neighbourhood however most conveyancers will still advise one. One of the main reasons is that the Enquiries of the local authority search is the only place to reveal indebtedness to the borough and this is more commonly the case with properties where the owner has gone into a home.

I heard that the official local Search in Barnardiston will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that councils are now in the process of locating polluted land parcels and recording these areas on registers – this is a process which will take a number of years to finish. Needless to say any properties listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Searches are likely to be incomplete.

Apart from showing that the property in Barnardiston is connected to the mains water supply and mains drainage what other details does a water authority search show? A Drainage & Water Enquiry illustrates to a future owner that the land they are acquiring does not need a “build over consent” because the seller has constructed an extension over a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

There is often a mortgage offer to apply for and it should be noted that a solicitor cannot rely on a quick email by mortgage broker or anyone else. The conveyancing solicitor must generally have sight of your formal written mortgage offer in order that they may (i) ensure that you are getting the money you need and be sure that you can comply with any conditions of the mortgage offer imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all costs required to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barnardiston some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is situated and possibly also building insurance.

Are you on the panel of First Direct? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Help to Buy ISAs in Barnardiston? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an real person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main residence. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional fees can we anticipate? We cannot give you all the costs up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information often in a questionnaire called LPE1. The charge for this varies from organisation to organisation mainly it is approximately £300 but is can be higher in unusual cases. Second, the lease may contains a provision for the selling to pay a payment to the freeholder based on a percentage of the sale price which is mainly 1% although other formula may be used. The lease will need to be checked carefully.
