Whilst this is to a lawyers and lenders an vital element of the home buying process to home buyers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In limited cases the results can be used to change your the price or and may even make you abort from the buying.

The search provides details of present and past pollution risks together with a statement from an environmental expert confirming whether or not the properties could be designated contaminated land by the council. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area where radon readings are over 100 Bq m-3.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Mouzzam was extremely helpful with our sale and purchase. Always quick to answer my frequent emails and kept us up to date with the whole process of buying and selling our home. I couldn’t fault the service that we recieved and wouldn’t hesitate to recommend them for conveyancing. We have now used KER on three separate occasions for a property purchase, sale and lease extension. On all occasions Mouzzam has provided a thorough, professional and prompt service. We would recommend KER. Very professional, prompt and efficient service.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long does conveyancing take? For relatively easy sale or purchase, expect the conveyancing of your property to take about 2 to 3 months.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a estimate what disbursements apply to your matter and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their legal fees disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all outlays needed to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barnham some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Barnham

Are you able to manage a mortgage with Virgin Money in Barnham? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Barnham? Is this a problem? No because like all modern practices we count on technology to assist us in our practice to ensure that matters are dealt with swiftly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barnham).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300,000 and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main home within 3 years.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold what additional disbursements can we anticipate? We cannot give you all the figures up front in our estimate. The costs charged by freeholder and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from company to company mainly it is approximately £300 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into a couple leaseholds.
