Searches on my Conveyancing Quote

What is included in a local authority search covering Barnoldswick? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is in need of an improvement or renovation grant. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

Do you recommend that we get an Environmental search on the property that we are buying in Barnoldswick? Yes we including this in our quote. We would always recommend an environmental search on the land parcel you intend to purchase which is available from a number of suppliers including Groundsure. The environmental check results provide details of present and past environmental risks together with a certificate from an environmental expert confirming whether or not the site, based upon the information revealed by the search, might be officially names as contaminated land by the council.

Apart from showing that the house in Barnoldswick is connected to the mains water supply and mains drainage what other details does a water authority search contain? A water authority search verifies to a potential interested party that the land they are purchasing does not need a “build over consent” because the seller has constructed an addition to the house close to a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your property to take between 2 to 3 months.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a quote what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on costs disguised as ‘disbursements’. Make sure that any estimates you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the date in Barnoldswick you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Barnoldswick

Are you on the panel of Bank of Ireland? Yes we act for all major lenders and many smaller lenders.

We are aware that you do not have an office in Barnoldswick? Is this a problem? No because like all modern firms of lawyers we count on technology to assist us in our work to ensure that matters are dealt with expeditiously. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barnoldswick).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main house. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main property within 3 years.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional payments can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is approximately £2500 but is can be more in extreme cases. Second, the lease usually contains a agreement for the selling to pay a payment to the landlord based on a % of the market value which is often 2% although other formula may be used. The lease will need to be checked carefully.

About Barnoldswick.

Barnoldswick (pronounced or locally /ˈbɔːrlik/) is a town and civil parish in Lancashire, England, just outside the Yorkshire Dales National Park and the Forest of Bowland Area of Outstanding Natural Beauty. Stock Beck, a tributary of the River Ribble, runs through the town. It has a population of 10,752.

Barnoldswick and the surrounding areas of West Craven were previously part of the historic West Riding of Yorkshire, but in 1974 local government was reorganised; West Riding County Council and Barnoldswick Urban District Council were abolished and the area transferred to the Borough of Pendle, Lancashire.

On the lower slopes of Weets Hill in the Pennines, astride the natural watershed between the Ribble and Aire valleys, Barnoldswick is the highest town on the Leeds and Liverpool Canal, lying on the summit level of the canal between Barrowford Locks to the south west and Greenberfield Locks just north east of the town, 30 miles (48 km) from Leeds, Manchester and Preston.

Nearby towns include Skipton to the east, Clitheroe to the west, Burnley to the south, and Keighley to the east southeast.
