Searches on my Conveyancing Quote

What is included in a local authority search covering Barns Green? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is in need of an improvement or renovation grant. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

Is there a need environmental searches in Barns Green? Statutory rules have resulted in a clear-up system for polluted land. The basic position is that the polluter should clear-up however where that party disappears (for example because the work was done some time ago or the company has gone into liquidation the liability for clean-up costs passes to the existing owner (who could be you). Even if you are purchasing an maisonette in Barns Green you may find that you are liable for the cost of any clear-up through the maintenance charge provisions of the lease.

Why is a a CON29 DW search salient if you want to extent or alter the property in Barns Green? One of the decisive replies shows the location of any public sewer nearby the house you are interested in. This is significant because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the works cost more.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

We had a lengthy process with our lender in relation to a re-mortgage which was a bit tedious but Mouazzam Yamin helped us to get to the end of what could have been a painful process. Grateful for the help and eventually completing which was a great moment for me! Excellent and proffesional conveyancing service received for the purchase of my property. Mouzzam Yamin and Mark Sadler were both very helpful and informative with replies to my queries. Easy to deal with and hassle free.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long does conveyancing take? For relatively normal sale or purchase, expect the conveyancing of your home to take between 2 to 3 months.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a quote what disbursements apply to your purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on costs disguised as ‘disbursements’. Make sure that any quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all costs incurred to repair the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barns Green some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain steps to ensure release of those monies including any bonus. If you complete the online quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to three hundred thousand pounds. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional disbursements can we anticipate? We cannot give you all the disbursements up front in our estimate. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from organisation to organisation mainly it is around £2500 but is can be higher in unusual cases. Second, the lease could contains a clause for the outgoing to pay a fee to the landlord based on a percentage of the market value which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
