What is a Local Authority Search and why is it needed in Barnstaple? Whilst this is to a solicitors and banks and building societies an important piece of the home buying process to buyers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In limited cases the results can be used to change your offer or and may even make you pull out of from the buying.

I am advised that the local Enquiries in Barnstaple will show if the land is contaminated. Is that right? That is not right. Whilst it is correct that Local Authorities are now in the process of identifying contaminated ground and recording these land parcels on registers – this is a process which will take a number of years to accomplish. Needless to say any land listed within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Search are likely to be incomplete.

What is a a CON29DW ? A a CON29 DW search confirms to a prospective buyer that the house they are purchasing is connected to the mains water supply and mains drainage. This is particularly important in parts of Barnstaple which are rural as there may be a a private drainage system.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a customer makes is not checking the plan properly. It is a good idea to go to the land parcel to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often consumers mistakenly think that a piece of land at the side or rear of the land is theirs, only to find out that the legal title to the land doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays necessary to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barnstaple some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Barnstaple

Are you able to conduct a mortgage with Aldermore in Barnstaple? Yes we are on the mortgage Panel for this lender.

We see that you do not have an office in Barnstaple? Is this a issue? No because like all modern firms of lawyers we count on technology to assist us in our practice to ensure that matters are dealt with quickly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barnstaple).

If you are a first time buyer what additional expenses can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your solicitor are required to make certain checks to ensure release of those savings including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

I am the administrators of my mother estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our fees remain the same as quoted for this type of Seller.

About Barnstaple.

Barnstaple ( or /ˈbɑːrnstəpəl/) is the main town of North Devon, England, and possibly the oldest borough in the United Kingdom. It was a river port at the lowest crossing point of the River Taw, flowing into the Bristol Channel. The town centre still preserves a medieval character.
From the 14th century, it was licensed to export wool. Great wealth ensued. Later the town imported Irish wool, but its harbour silted up and it developed other industries such as shipbuilding, foundries and sawmills. Its Victorian market survives, with a high glass and timber roof on iron columns. The parish of Barnstaple had a population of 24,033 at the 2011 census. The population of the built-up area was put 32,411 in 2018; Barnstaple Town Area, with nearby settlements such as Bishop’s Tawton, Fremington and Landkey, had a population of 46,619 in 2020.
