Searches on my Conveyancing Quote

How long do Local Authority search searches take? The ETA for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through our search provider’s website some searches are still processed managed manually by the council. Also the search time can be affected by seasonal demand levels and council staffing levels.

Do you recommend that I get an Environmental investigation on the property that we are buying in Barrow upon Trent? Yes we including this in our quote. We would always recommend an environmental search on the site you intend to purchase which is available from a number of search providers including Groundsure. The environmental enquiry results provide details of present and past environmental risks together with a assessment from an environmental expert confirming whether or not the land, based upon the information revealed by the search, could be designated contaminated land by the local council.

What is a drainage search ? A Drainage & Water Enquiry confirms to a future interested party that the property they are buying is connected to the mains water supply and mains drainage. This is particularly significant in parts of Barrow upon Trent which are country as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively typical sale or purchase, expect the conveyancing of your home to take between eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all costs necessary to upkeep the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barrow upon Trent some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

FAQs in Barrow upon Trent

Are you on the panel of Cambridge Building Society? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Barrow upon Trent? Is this a problem? No because like all modern firms we rely on technology to assist us in our practice to ensure that matters are dealt with promptly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barrow upon Trent).

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your solicitor are required to make certain checks to ensure release of those funds including any bonus. If you complete the estimate you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300,000. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional payments can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing information often in a questionnaire called LPE1. The charge for this varies from company to company usually it is around £200 but is can be more in rare cases. Second, the lease may contains a agreement for the selling to pay a charge to the landlord based on a percentage of the sale price which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.

Barrow upon Trent is a village and civil parish in the South Derbyshire district of Derbyshire, England with a planned massive business park, according to the Derby Telegraph, which will change the nature of the village. The village is south of Derby, and between the River Trent (to the south) and the Trent and Mersey Canal (to the north). According to the 2001 census the parish had a population of 546, increasing to 558 at the 2011 Census. Nearby places are Sinfin, Ingleby, Arleston, and Swarkestone.

One of the earliest mentions of this place is in the Domesday book where it is listed amongst the lands given to Henry de Ferrers by the King. The land included 8 acres (32,000 m2) of ground space and there were four oxen. Some of the land was described as “waste” but the value was put at two shillings.

The parish council owns an attractive row of ten Grade II listed cottages, known as “The Row”. These are rented to people with village connections. It also owns “The Pinfold”, a small walled area originally used for holding stray cattle.

The village is home to a Tarmac quarry.
